Basic principles

Hallands Auktionsverk AB, company registration number 556615-6039, Nässjögatan 6, 302 48 Halmstad (hereinafter "HA") is subject to the provisions of the EU's General Data Protection Regulation, and is the data controller for the information collected and processed about you as a customer. HA undertakes to respect and protect your personal data and your personal privacy in accordance with applicable legislation, industry rules and other relevant standards.

HA attaches great importance to the protection of the personal privacy of consignors, bidders, buyers and other persons who visit or otherwise have contact with HA, whether this takes place on the internet or during a personal visit or in some other way. Personal data and other data that is collected is, as a starting point, treated strictly confidentially in accordance with what is set out in this policy. What is prescribed in this data protection policy applies in addition to what is prescribed in HA's terms of purchase and terms of sale. These are available at hallandsauktionsverk.se. By visiting HA's website or viewing premises, or if you use HA's services in any other way, you accept what is prescribed in HA's data protection policy and HA's processing of your personal data. HA's data protection policy does not apply to other websites even if there are links to such on HA's website. The data protection policies of such operators should therefore be checked before their websites are visited.

What is personal data?

Personal data is information about personal or factual circumstances that relates to, or can be derived from, a particular person, for example information such as name, postal address, email address and the like.

Collection and processing of personal data

For anyone who visits HA's website, HA by default saves the IP address that the visitor has been assigned, from which web page the visit takes place, as well as the time and duration of the visit and all information in connection with the placing of bids. In addition, information is saved about how the customer otherwise interacts electronically with HA and about how HA's website is used. In addition to from the individual themselves, personal data regarding name, address and other contact information may be obtained from publicly available sources. Regarding anyone who registers as a bidder, credit reference information may also be obtained in accordance with applicable legislation. If special reasons exist, other personal data may also be obtained from external sources.

In order for HA to be able to fulfil its legal obligation in accordance with the Act on Trade in Second-Hand Goods (1999:271), information about your personal identity number or date of birth is collected, as well as verifying information (such as a copy of an identity document) when you submit an object for sale.

The personal data and bank account details you provide to us in connection with the sale of goods are stored in accordance with the Bookkeeping Act (1999:1078), and so that we can carry out payment to your bank account after a completed sale.

HA cooperates with police authorities within Sweden and the EU, and may, if legally required of us, disclose information to relevant authorities.

Use and forwarding of personal data

HA uses personal data provided by the individual and obtained in other ways to the extent required for technical administration and development of HA's website, administration of the bidding at auctions, handling of other customer-related matters, statistics and customer analyses and its own surveys in general, statutory disclosure of information, and the fulfilment of other tasks of general interest. For anyone who does not expressly forbid this, personal data provided and obtained in other ways is also used to provide information about HA's services.

Cookies

Cookies are small files stored on the visitor's hard drive. They facilitate navigation on HA's website and increase usability. HA uses cookies to learn about visitors' preferences and to design HA's website in an optimal way. HA also uses cookies to find out whether the visitor has previously visited HA's website. Only the cookie that has been saved on the visitor's computer (etc.) is then identified. Anyone who wishes to visit HA's website can do so even without cookies. This is done by changing the settings in the visitor's web browser.

Confidentiality

HA processes personal data provided and obtained strictly confidentially, with the exceptions set out in the following. Such personal data is not disclosed to any authority or to any individual company or to any individual person unless it is required to fulfil HA's contractual obligations in relation to HA's customers. Otherwise, personal data is only disclosed to the extent prescribed by law. Data may also, after a balancing of interests in each individual case, be disclosed to fulfil tasks of general interest. In these cases, data is disclosed only to the extent required in the individual case to satisfy the stated purpose. In addition, HA may disclose personal data in the event that HA engages external service providers who perform tasks on HA's behalf. A precondition is that these have a data protection policy that at least corresponds to this data protection policy with regard to the protection of personal data. HA never discloses any personal data to third parties for marketing purposes, unless the individual concerned has expressly approved such disclosure. All employees at HA, as well as the contractors HA engages for the handling of personal data, have been informed of the confidentiality and have undertaken in writing to comply with it.

How long is personal data stored?

Personal data is stored for as long as required to fulfil the purposes for which it was collected. If the individual concerned so requests, collected personal data is destroyed immediately, unless HA must retain the data in order to fulfil concluded agreements, fulfil a statutory obligation to provide information, or the data must otherwise be retained by law or so that HA can fulfil a task of general interest. In such cases, the data is stored for as long as, and to the extent, required for the agreements to be fulfilled, or for the prescribed disclosure of information to take place, or the data must for some other reason be retained by law (normally this means that the data must be retained for ten years), or must be retained so that tasks of general interest can be fulfilled (in such cases the data may be stored for more than ten years). Data of general interest primarily concerns data regarding cultural-historical documentation, cultural-historical provenance information, and data that may be relevant for the investigation of crime. Anyone who has provided such data to HA consents to the data being retained for the stated purposes.

Where is personal data stored?

Personal data provided and otherwise collected is stored in Sweden and/or another country within the EU, the EEA or in the United Kingdom. Names and email addresses, but no other personal data, may also be stored in the USA to the extent required for the sending of newsletters and invitations. Through agreements, it has in such cases been prescribed that the same data protection shall apply as under the EU's General Data Protection Regulation.

Right to information, complaints

Anyone who wishes to obtain information about, or rectification of, their own personal data processed by HA, or that provided personal data shall not be used for marketing purposes, has the right to request this free of charge in writing from HA at the following address:

Anyone who has questions about HA's handling of personal data or is dissatisfied with this handling can also turn to HA at the address just stated. Anyone who is still dissatisfied thereafter with HA's processing of personal data can lodge a complaint with the Swedish Data Protection Authority (www.datainspektionen.se), which is the Swedish supervisory authority regarding the EU's General Data Protection Regulation. Anyone who is dissatisfied can also turn to the supervisory authority in the country where they live or work.
